Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Album3D marketing website (the "Website") operated by 4AI Limited ("4AI Limited", "we", "us", or "our"). By accessing or using the Website, you agree to be bound by these Terms and all applicable laws and regulations. Use of the Album3D game distributed via Steam or other stores (the "Album3D game" or "Album3D app", together "Album3D") is primarily governed by the end user license agreement ("EULA") presented in that application and any applicable platform terms (for example, the Steam Subscriber Agreement). In these Terms, we use "Album3D", "Album3D game", and "Album3D app" interchangeably to refer to the same product. These Terms do not replace or limit the EULA. In the event of any conflict between these Terms and the EULA in relation to your use of the Album3D app, the EULA will prevail.

Album3D App License

The Album3D app is subject to a separate EULA that is made available within the app (and, where applicable, by the relevant platform provider such as Steam). That EULA (and any applicable platform terms) sets out the terms on which you may download, install, and use the Album3D app. These Terms do not grant you any license rights in relation to the Album3D app beyond what is provided in the EULA and platform terms.

For clarity, as described in our Privacy Policy, photos you import into the Album3D app generally remain on your device and are not uploaded to our servers unless we expressly state otherwise in the relevant app or service.

Use License

Subject to your compliance with these Terms, 4AI Limited grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Album3D marketing website and its content for your personal or internal business purposes, and only as expressly permitted by these Terms and applicable law. You may not reproduce, distribute, publicly display, or create derivative works of any part of the Website except as allowed by applicable law or with our prior written consent.

Restrictions

You may not:

• Use the Website in any unlawful manner or for any unlawful purpose, or in breach of these Terms;
• Copy, modify, distribute, or create derivative works based on any part of the Website, except as expressly permitted by these Terms or applicable law;
• Access or attempt to access the Website using automated means (including scraping, robots, or similar technologies) other than via publicly documented interfaces we provide;
• Interfere with or attempt to interfere with the proper working of the Website, or circumvent any security or access-control measures relating to the Website.

User Content

If you submit or upload any content to us through the Website (for example, through contact forms, feedback, or other interactive features), you remain solely responsible for that content. You retain any intellectual property rights you hold in such content, but you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content to the extent reasonably necessary to operate, improve, and provide the Website and our services.

Disclaimer

The Website, its content, and any information made available about the Album3D app are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, to the fullest extent permitted by law. Without limiting the foregoing, we do not warrant that the Website will be uninterrupted, secure, or error- free, or that any defects will be corrected. Any warranties in relation to the Album3D app themselves are governed by any applicable end user license agreements or service terms provided with those products or services.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall 4AI Limited, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with (a) your access to or use of, or inability to access or use, the Website; or (b) to the extent permitted by applicable end user license agreements or service terms, your use of any related products or services. Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

Updates and Changes

We may update or modify the Website and these Terms from time to time, for example to reflect changes in our services, our business, or applicable laws. When we make changes, we will update the "Last updated" date above and may provide additional notice where required by law. Your continued use of the Website after any changes to these Terms constitutes your acceptance of the revised Terms.

Termination

We may terminate or suspend your access to the Website (and, where applicable, related online services we provide) immediately, without prior notice, if you breach these Terms or if we are required to do so by law or by a competent authority.
